G'day Everyone
Just a bit of an outside chance. Looks like my current job is coming to an end. The business partners are parting ways and closing up shop. I could have as little as two weeks work.
Today i have been asked to take a day off. Though on wages I am sure it is leave with out pay.
Does anyone happen to know of some work in Horsham. Happy to do anything but need a little more than a rock bottom base pay.

How long since they lapsed? It would be easier to get your supervisors license again but the builders one would be harder. Average supervisors salary in project homes about $90k + car + phone + laptop

Inquire about getting your supervisors license again, its worth it, lots of jobs for hands on supervisors especially in extension work and restoration which you have an eye for

Try Tabma or HIA as I know with Tabma that you can look at what jobs are available. Good luck with finding a job.

Thanks ian. Looking it up now. Not sure if i fit. Looks like liquidation and bankrupcy. They have just ceased trading so not sure if that applies but will keep reading.

you should have some entitlement to some form of severance pay.
If the business can't pay then it's insolvent (can't pay its bills) so the safety net provisions should kick in for you.
Partnerships are tricky for the owners -- a principle called joint and several liability -- which might mean the owners have to liquidate the partnership to avoid any debts following them around like a bad smell.
Even if you end the partnership the debts still follow them around, the liability you refer to means any one partner can be sued for the lot.Quote:

registration as a company should make the process easier.
I suggest you keep a record of the days you are directed not to work (and what the direction was) and if the day is paid (= annual leave) or unpaid (which might translate into paid leave if you need to lodge a claim)
Should have given an update. The partnership / company was dissolved just ovet a week ago.
On the Tuesay night I recieved a call not to come in the next day as ine of the bosses (C...) was tied up with the accountant that day.
Wednesday night I recieved a similar call sayig prob mo work tilk Monday.
Over the weekend wad told to meet Monday and all would be explained.
Monday met on a job to be told would no longet be going to that Job as it was tied up with the ex partner. Told that Horsham Building and Renovation Supplies would no longer be paying my wages. Cant remember the exact words but to the effect that the company no longer exists.
That said I have unpaid holiday pay, 9 hours sick pay i was never paid and i presume some orher entitlements. I still have not recieved a group certificate and dont kow if they have been paying my taxes.
So the up shot. 'C' had offered me casual work on a need basis. The pay when you factor in being a contractor over being on wages means I am on 1/2 pay if I accept his offer.
Will be seriously looking at working for myself and watching the net for any other jobs that may be out there.
Thanks for all the info you have shared. I am trying to negotiate what is owed and if this fails will have to look at other avenues.

Hmm, dodgy bros inc. As for working for yourself you will need a valid license, insurances, etc. You will leave yourself open to litigation if you aren't licensed, be very careful Dave.
As for tax paid, contact ATO,they will be able to tell you.

Doesn't matter, the ATO will credit you for PAYG tax even if it hasn't been paid by the Company. The ATO is not able to tell you if it has been paid for privacy reasons. Contact you superfund though to see what has gone in, you can get the ATO to chase this up although you may be out of luck on that one.Quote:

By the sound of things, there's no money left in the company so it'll be I and other tax payers footing the bill.
Re-read the stuff on Fair Entitlements on the process you need to follow.
I'm guessing that "C's" accountant is acting as the liquidator.
Don't worry about the missing Group Certificate or unpaid PAYE tax, that's a problem for the business and the ATO.
a common reason for a business going bust is the business doesn't have the cash needed to pay the ATO.
However, a call to the ATO to ask what should you do in respect to your tax return and super contributions would be well worthwhile.
If the other partner has taken over the jobs, is there a possibility of working for that partner?

Tell him you'll work for him once all your back pay, redundancy etc have been paid up. If he's expecting you to work for under the minimum wage, go to the authorities and dob him in. Once all your entitlements have been paid and he's expecting you to work for almost nix, tell him to stick it where the sun don't shine, and do handyman work like someone else suggested, you get paid at the end of the job/day, and you're home with the littlies.

Interesting to say the least. 'C' had a go at me today because i dared question him. Doing a bathroom reno and he gave me silicon to waterproof the vilaboard behind a shower. He wanted me to just run a bead down the internals and not even tape any of the joints to the new boards.
I happen to know what he quoted and rough expenditure. Over and above all expenses including wages he stands to make 2.5 K maybe 3. When i said to his wife that he lied about not making mory on the job and there should be waterproofing before the tiling is done he went off in major way.
Yes Im looking at going alone.

Get out before you are made the scapegoat. Tell the client to get inspectors to have a look at the job before its too late or dob him in yourself. He will lie and say you didn't do as you were instructed. He's lying to the client, to his wife and giving the industry a bad name. Don't forget the photos !
My stand today led to waterproofing being delivered. I let the client know that it should be done and that I may not be back due to standing up for what was right. I got a foul reception from 'C' but respect and appreciation from the client.
They even rung me after work to see what went down after I saw my boss at the end of the day. I will get excellent word of mouth from them
