Talk about wrong place at the wrong time....

A motorist travelling home from her holidays was shot in the leg by a man trying to kill a cow, a court has been told.

Rudolf Stadler, 51, from Mooloolaba on the Sunshine Coast, has pleaded not guilty in the Brisbane District Court to one count of a negligent act causing bodily harm to 46-year-old Carrie Tunning.

In his opening address to the jury today, prosecutor Matt Nathan said that on April 17 last year Stadler offered his slaughtering services to his hobby farmer friend, Paul Tyson.

Mr Tyson wanted to kill a cow on his property at Caboolture, north of Brisbane.

Stadler used molasses and hay to lure the cow to an open-door shed and fired at it with a .234 Winchester bolt action rifle.

The first shot missed, so Stadler fired again.

This time the bullet passed through the back of the shed, through the door of a passing car and into the leg of Mrs Tunning, who was driving along Beachmere Road on her way back to Brisbane after a Sunshine Coast holiday.

"I heard this enormous noise like a rock hitting the car but much louder," Mrs Tunning told the court.

"I looked down and there was blood everywhere on my leg."

Mrs Tunning's husband took her to hospital with the bullet lodged in her leg and she has made a full recovery.

Mr Nathan told the jury they should find Stadler guilty of negligence because he failed to take "simple and reasonable precautions".

"The accused was a licensed owner of a high-profile rifle. As such he had a duty of care to ensure that when it was fired the rifle did not endanger the lives of (those around him)," he said.

"He failed to ensure that if it missed its target, it didn't injure a potential victim."

The trial before Judge Douglas McGill is continuing.

1. The .234 was more likely a .243.

2. What the F was he doing using such a big rifle to kill a poor defensless cow, up close, looking at him with those big brown eyes. A simple .22 rimfire would have pole axed most admirably I would think. :eek:

Years ago (puffs from pipe) a motorist in canberra hit a wallaby in peak hour. Motorists stopped and to calm skip they covered him in rug :rolleyes: . Looks just like a body under the blanket in front of the car with people slowly gawking as they drive past.

traffic cop arrives and walks up and shoots it in the head. Three motorists then call 000 to report a mad copper shooting injured motorists in the head.

Oh and then there was the local ranger who was crying as he tried to shoot another one. "this is so upsetting" he muttered through snot covered lips.

I agree with Outback a .22 would've done the job.

That reminds me of a case in the states where some nutter used a 303 to shoot at ducks or something, of course the ricochet went off and collected a poor motorist in the back of the head but they were not so lucky:mad:.

I knew a bloke in Squidley who used to go rabbit shooting with a 243. He used to say he needed to miss if he wanted any meat - a near miss would kill by concussion, a direct hit would destroy the carcass. Twit.

My though with this case was that if the git missed twice, he shouldn't have a licence ... but ability to use a cannon isn't part of the deal is it, only whether you have the fee.

Some years ago when the Flinders Medical centre in Adelaide was being built, a ramset nail went into a bituminous expansion joint instead of the concrete. Went straight through and killed a bloke working on the floor below.

A couple of New Jersey hunters are out in the woods when one of them falls to the ground. He doesn't seem to be breathing, his eyes are rolled back in his head.

The other guy whips out his cell phone and calls the emergency services. He gasps to the operator: “My friend is dead! What can I do?” The operator, in a calm soothing voice says: “Just take it easy. I can help. First, let's make sure he's dead.”

There is a silence, then a shot is heard. The guy's voice comes back on the line. He says: “OK, now what?"
