As this is my first time here be gentle. As everybody knows Australia in general has been hammered by mother nature and now the bureaucrats have stepped in as well.Over the last two long weekends, two of my mates have had visits from the authorities about working on public holidays and have been given verbal warnings. One mate who is an owner builder was cutting some 8x2s for his front fence and was warned he could face a fine of $1000,:((he wasn't affected by the floods. My other mate who had 3+ metres of water through his house had some tilers over to re-tile his bathroom and was warned he could face a $2000 fine. I personally think that this is poor form as everyone is trying to get ahead. So to all tradies out there, whether helping a mate out or working for yourself on a public holiday please be careful, as they say Forewarned is Forearmed. Cheers for now.

If it was on Anzac day they should have been fined for breaching the Anzac day memorial legislation.
If not, this falls in the category of it could only happen in Queensland.

Thanks Sturdee, Definitely not on ANZAC Day as this is sacred to any aussie and they would have deservedly been fined, as you say only in qld.cheers

According to the awards I have read you can work at any time.
Penalty rates generally apply but not always, depends on employment agreement.

I wonder what they think of mowing the yard on public holidays. Mines don't stop for public hols except for xmas and boxing day.

I cannot see how someone could lob around and tell a tradie or anyone for that matter, that he can't work when he chooses, let alone doing work for yourself.

Maybe the Missus donned a hard hat and a WH&S coat and told him he's not doing what he was told to. :D

It is a queer thing, real estate agents were told that they couldn't work on ANZAC day even though it was Easter & people were out & about wanting to look at property.
Convenience stores were open, servos were open, pubs & RSLs were open, all of them employ workers.

maybe the neighbours had complained about the noise?
As said theres no law against working on public holidays, swmbo worked all weekend and didn't even get penalty rates.

Hi all , it was mainly due to noise as I stated one mate was cutting 8x2s and the other had the tilers in and they were cutting tiles. All I want to do is try and alert people so that some unlucky person doesn't end up with a two grand fine,it's hard enough for anyone too make a dollar these days let alone donate it to the authorities. Cheers to all for your responses.

Hi Richie, so the issue was about noise.
I'm not surprised.
as far as the neighbours (and the noise police) are concerned, Public Holidays are supposed to be a bit like a Sunday. You can make some noise -- mow the lawn and do the edges -- but if you're talking longer term noise like milling a tree that's only supposed to be done on a normal work day.
around here, building approvals typically limit noisy activity to 7AM till 6PM Mon to Fri and 7AM to 2PM on Saturdays.

Thanks Ian, the sad thing about it all is one of my mates is trying to rebuild his life and get back on track after the floods and the other would have been lucky to have been using his saw for 1/2 an hour max, but I guess rules is rules, cheers for now,Richie

I don't think you can mow your lawn before 10am on weekends in VIC. Maybe that applies to Public hols as well.

As a neighbour I'll be fairly relaxed about noise from other neighbours -- after all we all trying to get different things done around the house.
But if one of the neighbours' had a tiler with a saw cutter working most of Good Friday, Easter Saturday and Easter Sunday come Anzac Day I'd be looking for blood.
same goes with cutting fence posts.
It's like noise from a party. Occasionally is OK, but if it's every Friday and Saturday night :((

Can you tell this to the "knob" over my back fence.
He has a huge pergola area and every morning, and I mean every morning at about 7.30ish he fires up the the petrol leaf blower thing and gives it a clean,

When my neighbor used to go on for a bit too long with his leafy I used to fire up the baby 1972 McCulloch. It was only 50 cc but it is LOUD! Only had to do it a few times and now he's pretty quick about it.

Nice one BobL, I thought of taking the muffler off the mower and running it flat out sometimes but as of yet haven't done this

Must be different rules about diferent noises and at what time. Complain about noisy late night parties and the police wnt all your deatails so they can tell the noise makers who complained!!!
